Beware of new Federal HIPAA regulations. Originally enacted in 1996 and recently modified for 2003, the Health Insurance Portability and Accountability Act will have new implications for surrogate decision makers attempting to access the medical records of a loved one. All existing Power of Attorney documents, Living Trusts and Health Care Directives should be reviewed by a qualified Elder Law Attorney to make certain that special language is included ensuring compliance with the new regulations. As an example, without necessary updates, it could be very difficult for a family member to obtain a disability certificate documenting a loved one's health-related disability or mental incapacity.
